Sect. 1 SCOPE OF APPLICATION
These General Terms and Conditions (GTC) apply to all deliveries by KB Sports Memories GmbH (hereinafter referred to as Sportmemories24) to consumers.
A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed primarily to their commercial or independent professional activity.
Sect. 2 CONTRACTUAL PARTNERS
The purchase contract is concluded with KB Sports Memories GmbH, Fuldaer Weg 2, 65835 Liederbach / Germany, Commercial Register: Amtsgericht Frankfurt am Main, HRB 111703.
Sect. 3 CONCLUSION OF CONTRACT
3.1 The presentation of the products in the online store does not constitute a legally binding offer, but only an invitation to order.
3.2 By clicking on the “Buy now” button, you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending you an order confirmation by e-mail immediately after receiving your order.
Sect. 4 PRICES AND SHIPPING
4.1 The prices stated on the product pages include statutory VAT and other price components.
4.2 In addition to the prices stated, we charge a flat rate of EUR 6.90 per order up to a purchase price of EUR 89.00 for delivery within Germany. The shipping costs are clearly indicated on the product pages, in the shopping cart system and on the order page. There are no shipping costs for orders with a purchase price over 89.00 euros for deliveries within Germany. Costs for international shipping can be found under the heading “Shipping” on our website.
Sect. 5 DELIVERY
5.1 We deliver to Germany, the EU and other selected countries with DHL. We may use other shipping partners up to our discretion
5.2 The delivery time is up to 3 days in Germany. We will point out any deviating delivery times on the respective product page.
Sect. 6 PAYMENT
6.1 Payment must be made at the time of purchase.
6.2 Different options of payment are available and displayed at time of ordering.
Sect. 7 RETENTION OF TITLE
The goods remain our property until full payment has been made.
Sect. 8 WARRANTY FOR MATERIAL DEFECTS
Sportmemories24 is liable for material defects in accordance with the applicable statutory provisions, in particular §§ 434 ff of the German Civil Code.
Sect. 9 SETTLEMENT OF DISPUTES
The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts.
